Terms of Service

These Terms of Service ("Terms") govern your use of the Amps & Octane mobile application and any related services (together, "the Service"), operated by LifeByTheMile ("we", "us", "our") from Canada. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

• "You" means the individual using the Service.
• "Account" means the email-and-password user record created through Firebase Authentication that lets you access your data.
• "Service" means the Amps & Octane app (Android, iOS, and web), its associated cloud functions, and the ampsoctane.com domain.
• "Premium" means the optional paid subscription tier.

2. Eligibility

You must be at least 17 years old to use the Service. By creating an Account, you represent that you meet this age requirement and that you have the authority to accept these Terms. The Service is intended for personal, non-commercial use of tracking your own vehicles.

3. Your Account

You are responsible for the security of your account and for all activity that happens under it.

• Use a strong, unique password.
• Do not share your password.
• Tell us promptly if you believe your account has been compromised.
• The optional biometric lock screen inside the App is a convenience feature, not a substitute for a strong password.

We may refuse to register, suspend, or terminate an account if we believe it is being used in violation of these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for anything illegal.
• Upload content you do not own or have permission to share (e.g. photos of vehicles you have no right to photograph).
• Attempt to break, reverse-engineer, decompile, disassemble, scrape, or overload the Service.
• Try to access another user's account or data.
• Use the Service to harass anyone, send spam, or distribute malware.
• Fake locations, odometer values, or receipts to defraud insurance companies, employers, tax authorities, or anyone else.
• Use automated scripts, bots, or crawlers to access the Service without prior written permission.

We may remove content and/or terminate accounts that violate this section.

5. Premium Subscription and In-App Purchases

Some features are offered as part of a paid Premium tier — currently CSV export, CSV import, cloud backup, and ad removal. Premium is sold through:

• The Apple App Store on iOS, or
• The Google Play Store on Android.

The store you purchased from handles billing, and the store's own terms govern the transaction.

• Payment: Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) at the confirmation of purchase.
• Auto-renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• Managing your subscription: You can manage or turn off auto-renew at any time from your device's account settings — App Store account settings (iOS) or Google Play → Subscriptions (Android). Cancellation takes effect at the end of the current paid period; you retain Premium access until then.
• Refunds: Refunds are handled by Apple or Google according to their respective refund policies. We cannot issue a direct refund for a store purchase. In-app purchases are generally non-refundable except as required by applicable law or the store's policies.
• Price and feature changes: We may change the price or feature set of Premium with reasonable notice, in line with the rules of the store.

6. Intellectual Property

The Amps & Octane app, its design, code, logos, trademarks, and all associated content are owned by LifeByTheMile or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted by these Terms.

All rights not expressly granted to you are reserved.

7. Your Data and User-Generated Content

You own the data you put into the App (vehicles, logs, expenses, photos, etc.). You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, copy, process, and display that data solely as needed to operate and improve the Service. This licence ends when you delete your account, except as described below.

You also grant us the right to use your data in de-identified, aggregated form — combined with data from other users so that no individual can be identified — to analyse usage patterns, improve the Service, and create industry research, analytics, or reports that may be shared with or sold to third parties. This aggregated-data licence survives account deletion because the data, once anonymized and combined, can no longer be attributed to you.

How we handle your data is described in our Privacy Policy. Please read it.

You can export your logs and expenses as CSV from inside the App with a Premium subscription (Settings → Export CSV), or by emailing [email protected]. You can delete your account at any time from Settings → Account → Delete Account.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, to the maximum extent permitted by law. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular:

• Efficiency, range, cost, and savings calculations are estimates based on the data you enter. They are not financial, tax, accounting, or regulatory advice.
• Vehicle data — including VIN-decoded specifications, weather data, charger or station information, and reminders — should not be relied upon for safety, maintenance, or legal compliance decisions. Always verify against your owner's manual, your dealer, the manufacturer, and qualified professionals.
• We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses; that bugs will be fixed; or that any data will not be lost.

9. Third-Party Services

The Service relies on third parties — Google Firebase, Google AdMob, Google Cloud, NHTSA vPIC, Open-Meteo, OpenStreetMap, Apple, and Google Play. We are not responsible for the acts or omissions of those third parties, and your use of them is subject to their own terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Service.
• Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for Premium in the 12 months before the event giving rise to the claim, or (b) $50 CAD.

Some jurisdictions do not allow these limits — in that case, the limits apply to the fullest extent permitted by local law.

11. Indemnification

You agree to indemnify, defend, and hold harmless LifeByTheMile and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

12. Termination

• By you: You may stop using the Service and delete your account at any time from inside the App (Settings → Account → Delete Account), or by emailing [email protected].
• By us: We may suspend or terminate your access if we reasonably believe you have violated these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to risk.
• Effect: When your account ends, the licences in Section 7 end, and we will delete your data as described in the Privacy Policy. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada that apply there, without regard to conflict-of-laws rules.

The courts located in British Columbia have exclusive jurisdiction over any dispute arising from these Terms or the Service, except that you may bring a claim in your local court of residence where required by mandatory consumer law.

Before bringing any formal claim, you agree to first try to resolve the dispute informally by contacting us at [email protected]. If the dispute is not resolved within 30 days, either party may proceed with formal proceedings.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent possible and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will update the "Last updated" date at the top and, where required, notify you in-app or by email before the change takes effect. Continuing to use the Service after the change means you accept the new Terms.
